Access to and use of the website, as well as use of services and products provided by HomeFoods Pte Ltd shall be subject to the following terms and conditions. By using the website and services and products of HomeFoods Pte Ltd, you have read, understood and accepted these terms and conditions, and agree to be bound by them.
These terms shall apply to all visitors, users and others who access or use the services provided by HomeFoods Pte Ltd.
HomeFoods Pte Ltd shall reserve the right, from time to time, with or without notice to you, to change and/or amend these Terms and Conditions at its sole discretion. The Terms and Conditions applicable to your access to and use of this website will be the version that is current and displayed on the website as at each date you access the website. Your use of the HomeFoods Pte Ltd website after changes are made means that you agree to be bound by such changes.
HomeFoods Pte Ltd shall endeavour to provide information which is free from error, but will not warrant as to the information’s adequacy, accuracy or completeness. HomeFoods Pte Ltd shall not be liable for any errors or omissions relating to the information provided.
HomeFoods Pte Ltd shall accept no liability except for events covered within the Terms and Conditions or statutorily provided for by the Laws of the Republic of Singapore.
When you create an Account with HomeFoods Pte Ltd, the information provided must be accurate, complete and current at all times. Failure to do so shall constitute a breach of the Terms, which may result in immediate termination of your account on this service.
You understand that HomeFoods Pte Ltd will contact and communicate with you via the information provided by you pursuant to Clause 2(1) above.
Any notices made by HomeFoods Pte Ltd shall be considered as communicated to you by means of email and/or notice on the website. HomeFoods Pte Ltd reserves the right to refuse any or all liability with regard to information provided to HomeFoods Pte Ltd which is faulty or wrongly entered pursuant to Clause 2(1) above.
You will be responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account.
You must not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
HomeFoods Pte Ltd reserves the right to investigate, suspend and delete any accounts registered for fraudulent purposes at HomeFoods Pte Ltd’s sole discretion.
An Account with HomeFoods Pte Ltd is required in order for you to place your orders with HomeFoods Pte Ltd.
HomeFoods Pte Ltd reserves the right to fully suspend your Account until all outstanding balances are paid in full and received by HomeFoods Pte Ltd.
HomeFoods Pte Ltd reserves the right to use information provided to us by you in the registration of the Account to market its products and services to you, even after Termination of the Account, unless otherwise advised by you.
Placement of Orders
HomeFoods Pte Ltd operates a pre-order service. Deliveries will be made weekly subject to your order, which must be made in accordance with Clause 2(8) above.
The minimum order required for delivery is Singapore Dollars (S$) 45.00. A delivery fee of Singapore Dollars (S$) 10.00 is payable for each delivery trip. The delivery fee is waived for orders Singapore Dollars (S$) 100.00 and above. HomeFoods Pte Ltd reserves the right to change this whenever appropriate.
Upon making a selection, you will receive an email confirmation upon receipt of monies by HomeFoods Pte Ltd.
HomeFoods Pte Ltd will take orders on a weekly basis viz the online website at www.homefoodsgroup.com. Orders must be placed online and confirmed by HomeFoods Pte Ltd latest by 3pm of Wednesday each week. Each order is for 2 persons. The fulfilled orders will be delivered in accordance with Clause 3(5).
Orders may be placed prior to the delivery date stipulated hereunder. Orders will be fulfilled no later than by noon (12 p.m.) every Thursday. Requests may be made for deliveries to be made on Saturday or Sunday during the various time slots provided, subject to availability. HomeFoods Pte Ltd will confirm these details with you via the information provided by you pursuant to Clause 2(1) above. Deliveries may be available on other days for purpose of celebrating occasions and public holidays. These will be announced on the website.
HomeFoods Pte Ltd reserves the right to determine, and if necessary, alter the available products according to availability and popularity on a weekly basis, and the Meals available on the HomeFoods Pte Ltd website shall be deemed to be the Meals available for the Week during which the Order is made.
Persons placing an order for alcohol from HomeFoods Pte Ltd must be aged 18 or over. Alcoholic beverages can only be sold and delivered to persons aged 18 or over. By placing an order that includes alcohol, you warrant that you are at least 18 years old. HomeFoods Pte Ltd reserves the right to refuse to deliver any alcohol to any person who does not appear, or cannot prove they are, aged 18 or over.
Cancellation or Termination of Order
No Cancellation of Order is allowed.
Availability of Products Featured on Website
HomeFoods Pte Ltd will endeavour to fulfil orders placed with products shown on the website.
Without prejudice to the rights of HomeFoods Pte Ltd as stipulated in Clause 1(4) and 3(6) above, all products displayed on the website are subject to availability and should the product become unavailable thereafter, HomeFoods Pte Ltd reserves the right to limit quantities of orders and/or to reject all or part of the order, to discontinue certain products and to substitute products without prior notice.
Where necessary, HomeFoods Pte Ltd shall endeavour to make substitutions of product equal of or higher quality and/or value to the substituted product.
HomeFoods Pte Ltd shall not be required to give notice to you in the event Clause 5(1) to (3) becomes necessary.
HomeFoods Pte Ltd may, from time to time, provide discounts and run Promotions for you. Homefoods Pte Ltd reserves the right to remove and/or amend any offers or discounts made at any time pursuant to its policies without reference to you.
HomeFoods Pte Ltd shall not be held liable for any discounts and promotional offers which are no longer applicable or available to you.
Payment shall be through mastercard, visa, cash on delivery or Internet Banking.
HomeFoods Pte Ltd reserves the right to modify, alter, or change its required mode of payment without reference to you.
Delivery of Products
Delivery of Products will be made to the address provided in registering your account subject to Clause 2(1) above, HomeFoods Pte Ltd shall only be liable for products delivered to the address stated in the registration details.
Should an alternative address be required for delivery, and subject to a limited waiver of Clause 8(1) above, only under special circumstances will an alternative address be considered for delivery, if HomeFoods Pte Ltd receives notice of, and accepts therein, the alternative address by 3.00 p.m. of the Friday preceding the delivery date.
You will be responsible for inspecting all Products at the point of receipt and to inform immediately if there exists any spoilage, damage or otherwise rendering the Product unfit for consumption.
You will be responsible for ensuring that the Products received are fit for use and consumption by immediately refrigerating the Product.
HomeFoods Pte Ltd shall not be liable for any claims arising from Products claimed to be unfit for consumption should Clause 8(3) and (4) above not be applied.
Should delivery be substantially delayed due to, but not limited to, inclement weather, unfit transportation or otherwise by more than three (3) hours, HomeFoods Pte Ltd will contact you to arrange an alternative delivery date. If the alternative delivery date is unsuitable within reasonable circumstances, HomeFoods Pte Ltd will credit your account with the value of the order for use against your subsequent orders.
If delivery falls on a public holiday, HomeFoods Pte Ltd will deliver on the day before or after the public holiday, and you will be notified of the change.
If the Product delivered is wrong, you may either retain the product without any refund to your account, or refuse to accept the wrong product at the point of delivery. Any wrong orders and/or products prior to delivery will be deemed to be correct and accepted pursuant to Clause 9(3) above, and HomeFoods Pte Ltd shall not be required to make a refund, credit, or compensation otherwise for such orders.
Should the Product delivered be wrong, in accordance with Clause 8(8) above, HomeFoods Pte Ltd will endeavour to replace the product, in default of which under reasonable circumstances, HomeFoods Pte Ltd will credit your account with the value of the order for use against your subsequent orders.
Ownership, responsibility and risk arising from the product shall pass to you upon delivery of the product, at the point of delivery and upon acceptance of the product.
Acceptance is to be determined as receipt of the product by any individual residing or purporting to reside at the delivery address, and is deemed to be authorized to accept such product.
Should you be unable to receive the product, delivery and acceptance will be constituted by the Order being left at your door.
HomeFoods Pte Ltd reserves the right to use third parties to deliver your packages.
Use of Products
You are to follow all cooking and cleaning instructions on the recipe, especially with regard to time of cooking and methods of cleaning to prevent any food poisoning or illness arising from consumption of the Product.
You are to follow safe food handling practices to reduce the risk of any foodborne illnesses.
HomeFoods Pte Ltd shall not be held liable for any illness, sickness or detriment to health which shall arise from the consumption of its Products if Clauses 9(1) and (2) are not applied.
If you identify any missing or damaged ingredients in the Product, HomeFoods Pte Ltd will require photographic documentation of the missing or damaged ingredients as proof of the same before replacement, or credit in lieu of the replacement is made to your account for the value of the missing or damaged ingredient.
Your Order with HomeFoods Pte Ltd is for personal consumption only, and the Products which you will receive shall not be used for re-sale or distribution purposes.
HomeFoods Pte Ltd reserves the right to rescind, cause any action, or refuse any liability which shall arise from the breach of Clause 9(5) above.
Damaged or Defective Items
All products must be inspected upon receipt and you must notify HomeFoods Pte Ltd immediately of any defects or spoilage.
HomeFoods Pte Ltd shall reserve the right to replace damaged or defective foods pursuant to Clause 9(4) herein, if it deems that such damage or defect was not caused by HomeFoods Pte Ltd and/or its agents.
General HomeFoods Pte Ltd Terms and Conditions apply to the purchase of Gift Certificates and the orders made using any purchased or gifted Gift Certificates.
For the avoidance of doubt, the term "Gift Certificates" as used in Clause 11 refer only to Gift Certificates purchased directly from the HomeFoods website (https://homefoodsgroup.com/).
HomeFoods Pte Ltd reserves the right to amend these Terms and Conditions regarding the Gift Certificates without any prior notice.
Purchasing Gift Certificates
You can buy multiple Gift Certificates for personal use or as gifts.
Gift Certificates are not refundable in cash or replaceable if lost, destroyed or stolen.
Gift Certificates are digitally delivered to the named recipient(s) at their email given by you at point of purchase. Proof of delivery takes place once the Gift Certificates are emailed to the named recipient(s) and copied to the purchaser. All ownership, responsibilities and risk pertaining to these Gift Certificates shall pass to named recipient(s) at this point.
Use of Gift Certificates
Gift Certificates can only be redeemed against the meals available on the HomeFoods website at time of redemption.
Only One Gift Certificate can be redeemed per online transaction.
Gift Certificates can be used as full or part payment for orders in a single transaction made on the HomeFoods website. Purchases made with Gift Certificates are not refundable in whole or in part by cash or credits. Any remaining amount will be automatically forfeited once your order is placed. Any shortfall will have to be settled by any of the payment methods referred to in Clause 7 above, before the orders are accepted for processing.
All Gift Certificates will have a validity period which will be clearly stated on the Gift Certificates itself. Gift Certificates not used within this validity period will be forfeited with no entitlement to refund, exchange, extension or credit.
Without Prejudice to Clause 2(9) above, you will allow HomeFoods Pte Ltd to use your details for marketing purposes or any other purposes as HomeFoods Pte Ltd shall deem fit.
All feedback and reviews, photos posted on the linked sites are non-confidential and shall be the sole property of HomeFoods Pte Ltd.
HomeFoods Pte Ltd shall own exclusive right to, including without limitation, all intellectual property rights relating to the materials described in Clause 11(3) above, and will have unrestricted use and dissemination of the materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
Disclaimer of Warranties and Limitations on Liability
Nothing in this Clause 12 or otherwise in these Terms and Conditions shall exclude or in any way limit HomeFoods Pte Ltd’s liability for;
Death or personal injury caused by its negligence
The website and its contents are provided on a ‘as is’ and on an ‘as available’ basis and no representations or warranties of any kind are made with respect to it. Clause 15 of these Terms and Conditions shall apply with regards to the merchantability of raw foods provided by HomeFoods Pte Ltd.
Products sold by HomeFoods Pte Ltd is not designed to cater for allergies or specific or cultural dietary requirements. You will bear the sole responsibility of checking the ingredients as detailed on the description of each meal on the website prior to ordering and in the recipe card and in the packages to avoid consumption of such items.
HomeFoods Pte Ltd assumes no liability or responsibility for any errors or omissions in the content of the website, any failures, delays or interruptions in the delivery of products, any costs, losses expenses or damages arising from the use of the content provided on the website or any conduct by users of the website. Subject to Clause 12(1), all representations and warranties, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement, are disclaimed. The information accessible on the website is not represented or warranted to be accurate, complete or current.
Subject to Clause 12(1), the shareholders, directors, officers, employees or agents of HomeFoods Pte Ltd shall not be held liable (jointly or severally) for any special, incidental, indirect, or consequential damages of any kind, or damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out or in connection with the use or performance of these information. Should Clause 12(3) be in contravention of any local laws of the Jurisdiction of Singapore rendering the said Clause unenforceable, liability shall be limited to the fullest possible extent permissible in law.
Subject to Clauses 12(1) to (4), the maximum liability attributable to HomeFoods Pte Ltd (in contract, tort, negligence, breach of statutory duty or otherwise) arising out of or in connection directly or indirectly with the use of the website, its content or HomeFoods Pte Ltd’s services shall not exceed the sum of S$100.00 or the total amount paid in respect of services rendered by HomeFoods Pte Ltd for the Order, whichever sum shall be lower.
This website is controlled and operated by HomeFoods Pte Ltd, and its use is governed by these Terms and Conditions, to be construed and enforced in accordance with the laws of the Republic of Singapore. Disputes arising from your use of this website and the services provided are to be mediated at the Singapore Mediation Centre (SMC), following which by arbitration at the Singapore International Arbitration Centre.
Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre ("SIAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this Clause.
The seat of the arbitration shall be Singapore and the Tribunal shall consist of one (1)The language of the arbitration shall be English.
Failure to exercise or enforce any right available to HomeFoods Pte Ltd under these Terms and Conditions does not constitute a waiver of that right or any other rights under these Terms and Conditions.
HomeFoods Pte Ltd shall not be held liable for any lack of performance, or the unavailability or failure of this website or services, or for any failure by HomeFoods Pte Ltd to comply with the Terms and Conditions, where such lack, unavailability or failure arises from causes reasonably beyond the control of HomeFoods Pte Ltd.
HomeFoods Pte Ltd shall bear no liability in the event of a “Force Majeure Event”, which shall include, but is not limited to the events as set out in Clause 15(3) herein;
Force Majeure Events include in particular (but are not limited to) the following and events which HomeFoods Pte Ltd has no reasonable control over:
Temporary/permanent disruption in supply of foods/products;
Strikes, lock-outs or other industrial action;
Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters and Acts of God;
Impossibility of the use of railways, roads, shipping, aircraft, motor transport or other means of public or private transport;
Impossibility of the use of public or private telecommunications networks; and
Acts, decrees, legislation, regulations or restrictions of any government.
HomeFoods Pte Ltd shall be entitled to suspend performance of any or all services for the period that the Force Majeure Event continues, and shall have an extension of time for performance for the duration of the period. All reasonable endeavours to bring the Force Majeure Event to a close, or to find a solution by which obligations and services can be continued despite the Force Majeure Event shall be made and/or attempted.
HomeFoods Pte Ltd reserves the right to refund all or part of any services paid by you, in the event such events shall occur without further reference to you.
Third Party Rights
In accordance with Clause 1(3), HomeFoods Pte Ltd reserves the right to rescind, waive, assign, release or vary any or all of the provisions in this Agreement in any way without consent of any third party.
You shall agree to indemnify and hold HomeFoods Pte Ltd, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable legal fees, arising out of or in connection with any breach by you of these Terms and conditions or any violation by you of any applicable laws or the rights of any third party.
